i. Foundation

Taste of Mediation

3-hour signature skills workshop

A focused introduction to mediation and ADR for law students. Participants are introduced to the concept and philosophy of mediation, how it differs from litigation and arbitration, the functional stages of the process, and the core skills of the mediator: active listening, effective questioning, reframing, and neutrality. Includes 45 minutes of role play and mock mediation, so you experience the process rather than merely hear about it.

The method

The process you will learn, stage by stage.

Both programs follow the structured, stage-wise approach to mediation. Every stage is first demonstrated, then practised in role play.

Introduction and opening statements

The mediator establishes neutrality, confidentiality and ground rules, and each party states its case without interruption.

2.

Joint session

Issues are identified and framed, information is gathered, and the parties begin to hear each other's interests, not just positions.

3.

Separate sessions

Confidential caucuses where the mediator reality-tests each party's alternatives using BATNA, WATNA and MLATNA, and generates options.

4.

Closing and settlement

Terms are negotiated, refined and recorded in a clear, workable and enforceable settlement, or the matter is closed without agreement.

How you learn

Simulation-based, by design.

Mediation skills are acquired through practice, not lectures. Both programs are built around doing the work: structured role plays, mock mediations, high-intensity simulations of deadlocks and emotional volatility, and live expert feedback on how you conducted the session. Participants leave having mediated, not just having read about it.

The curriculum

Inside the 40+ hour program.

Seven modules. Every module stands independently, yet together they form a single integrated dispute resolution curriculum and a cohesive mediator's mindset.

  1. Module 1: Foundations of Mediation8 hrs

    The concept and philosophy of mediation, mediation law, ethics, confidentiality and enforceability, ADR jurisprudence, dispute system design, BATNA, WATNA and interest mapping.

  2. Module 2: Types of Mediation7 hrs

    Civil and commercial mediation, family and matrimonial disputes, criminal and compoundable offences, and corporate and workplace conflicts, with domain-specific strategy for each.

  3. Module 3: Steps of Mediation and Negotiation Strategies9 hrs

    The process end to end: intake, opening statements, issue framing, joint sessions, caucuses, reality testing, negotiation leverage, option generation and settlement architecture.

  4. Module 4: Roles in Mediation6 hrs

    The mediator as process architect and guardian of party self-determination, alongside the functions of lawyers and case managers, with attention to power asymmetry, emotion, bias and stakeholder dynamics.

  5. Module 5: Role Plays and Simulations7 hrs

    High-intensity simulations focused on resistance, deadlocks, emotional volatility, cognitive bias, and advanced reframing and recalibration techniques.

  6. Module 6: Mediation Moots4 hrs

    Mediation moot structure, persuasive framing, caucus management, BATNA evaluation and live expert feedback.

  7. Module 7: Live Expert Sessions4 hrs

    Advanced negotiation, ethical judgment, multi-party disputes, career pathways, court integration and professional positioning.

Certification

Certificate of Trained Mediator, valid for 5 years from the date of certification, under the mentorship of Meena P. Waghray.
